Below you will find the terms of use for the SolarDashboard app. We attach great importance to the protection of your personal data. Please also note our privacy policy. These are part of the present terms of use.

Scope of these Terms of Use

SolarDashboard is an app to monitor the performance of your photovoltaic system. Furthermore, the app enables solar power dependent control of devices – like HomeKit, home chargers or electric vehicles, so you can e.g. charge your electric vehicle with surplus solar power.
By using the SolarDashboard app, you accept the SolarDashboard Terms of Use.

Costs for using the services of SolarDashboard Connection fees

The basic functions of SolarDashboard are provided free of charge. These include displaying the solar and consumption values of the solar system, connecting electric cars, wallboxes, and HomeKit devices. Additionally, controlling these devices based on solar power is also free of charge. Some advanced features, such as charging and switching with surplus solar power, are available for a monthly fee. Information about the available additional features can be found within the app. The monthly subscription for the additional features is billed through Apple’s payment system. The costs for the subscription may vary depending on availability and country and are visible within the app. The subscription can be canceled at any time.

Change in the scope of services of SolarDashboard

SolarDashboard reserves the right to change, expand, limit or discontinue the content, graphics and/or functionalities of the SolarDashboard app and/or the solutions offered by SolarDashboard at any time. The same applies to the services offered by SolarDashboard.

Availability

The user acknowledges that SolarDashboard cannot technically guarantee a temporally uninterrupted availability of its own app and the services of third parties (in particular the connection to the systems of the electric vehicles or solar inverters or home chargers) and that the user has no claim against SolarDashboard for such continuous availability. In particular, SolarDashboard reserves the right to limit or temporarily suspend its services for maintenance, security or capacity reasons at its sole discretion.

Obligations of the user

Private and Commercial Use:
User agrees to use SolarDashboard only for lawful, reasonable, and in accordance with these Terms of Use and any other related terms of use, applicable policies or guidelines. Therefore, User is not permitted to use the services provided and publicly available on the SolarDashboard platform, including any content and functionality, in any manner other than as described and provided.

Disturbances and abuses are to be refrained from:
The user is further obligated to refrain from all actions that are likely to impair the functionality of the SolarDashboard platform and services, in particular to overload them.

Liability of SolarDashboard

For damages incurred by a user due to a slightly negligent breach of duty attributable to SolarDashboard, SolarDashboard is liable only to the extent that the damage is foreseeable and typical for the type of service and is directly caused by the breach of duty. In particular, the liability for data loss is limited to the typical recovery effort that would have occurred if backup copies had been made regularly and in accordance with the risk. If the slightly negligent breach of duty is not essential to achieve the purpose of the contract, the liability of SolarDashboard is excluded.
SolarDashboard does not assume any warranty for the functionality of externally connected services of third parties (electric vehicles, solar inverters, home chargers or HomeKit devices). Furthermore, SolarDashboard shall not be liable for any defects, errors or damages incurred in connection with third party services.

The foregoing limitations of liability also include claims by the user for reimbursement of such expenses as the user has incurred and could have incurred in reliance on the receipt of a service in accordance with the contract.

In addition, SolarDashboard is liable to users without limitation for damages covered by liability under mandatory statutory provisions and in the case of the assumption of a guarantee by SolarDashboard.
Unless otherwise stated in the above provisions, any liability of SolarDashboard – for whatever legal reason – is excluded.

Data protection

SolarDashboard will process the data provided by the user electronically only for purposes arising from the contract concluded by the user for the use of SolarDashboard’s services. Accordingly, SolarDashboard will only disclose the data to third parties within the scope of the purpose of the contract.

Final clauses

SolarDashboard reserves the right to change these Terms of Use at any time and without giving reasons, unless this is not reasonable for the user. SolarDashboard will inform the user about changes to the terms of use in a timely manner. If the user does not object to the validity of the new terms of use within six (6) weeks after notification, the amended terms of use shall be deemed accepted by the user. SolarDashboard will inform the user in the notification of his right to object and the significance of the objection period.

Unless otherwise agreed, the user may submit all declarations to SolarDashboard by e-mail or send them to SolarDashboard by letter.

These Terms of Use shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction for all disputes arising from these Terms of Use is the registered office of the service provider, insofar as such a jurisdiction agreement is permissible.

Should individual provisions of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions.
